MY KIND OF CRUISE COMPETITION GENERAL TERMS AND CONDITIONS
The Competition
- When you enter any competition promoted by My Kind Ltd (Trading as My Kind of Cruise), you agree to be bound by the Terms and Conditions to follow. Filling out an entry in any format(s) available will be deemed an acceptance of the Terms and Conditions below. Any and all information on entering the competition and any specific instructions posted on social media or any other platform (including but not limited to App and website) available for entry, is also incorporated into the Terms and Conditions below.
- The Promoter is My Kind Limited and its affiliated companies (in each case, the "Promoter", "we", "us" and "our").
- For the purposes of these Terms and Conditions, the Promoter includes (a) My Kind Ltd and also any agents, sponsors and event promoters involved in organising competitions or promotions on behalf of My Kind Ltd
Participation in the Competition
- The Competition is only open to residents of England, Scotland, Wales and Northern Ireland, who are aged 18 years or older, to comply with the age limits of travel of the majority of cruise companies (unless stated otherwise in the competition information, in which case this will be 21 years of age or older).
- The following are not eligible to enter My Kind Ltd competitions:
- employees and agents of the My Kind Ltd
- employees and agents of any company or group directly connected with the operation or fulfilment of the competition (including third party promotional partners)
- immediate family of any such employed persons referred to in above (a) & (b)
- By entering the competition, you agree that you are able to conform to the above terms and prove this if deemed necessary.
- The start date and closing date of the competition are stated in the promotional materials connected to the promotion locally on the channel of entry. Any entry outside of the entry period date and/or time will be disqualified and therefore will not be taken into consideration in the selection of a prize winner.
- You must comply with the laws that apply to you in the jurisdiction that you access the competition from. Where the laws applicable to you restrict or prohibit you from entering, you must refrain from entering the Promotion, in line with the local laws.
- To enter the competition, an entrant must submit their answer or entry, using only an official method as specified on the competition page or promotional materials.
- Entrants can enter once per person during the competition period, unless otherwise stated. All additional entries by the same person will be voided.
- My Kind Ltd reserves the right to remove any entries submitted where we suspect a breach of the Terms and Conditions in whatever manner applicable.
- Entrants should be aware that they may be subject to charges for data at the rate of their provider if they enter the competition online or by email. Whilst entry is free, My Kind Ltd are not responsible for any extraneous costs incurred while entering any promotion.
- If entrants fail to provide any mandatory information required when participating, their entry will be voided.
- There will be one winner of the Competition (the Winner) who will receive the Prize, unless stated otherwise in the specific promotional entry information.
- The Winner will be selected at random from all valid entries received during the competition period and no correspondence will be entered into.
- The Competition Prize will be set out in the promotional materials along with any applicable dates that the Winner would be expected to be available (in order to avail of the prize), in advance of entry
- If a Prize becomes unavailable for any reason, My Kind Ltd reserves the right to substitute an alternative Prize at their sole discretion and no cash alternative will be offered.
- The Prize is subject to the terms and conditions of the relevant supplier and their privacy policy will apply to the processing of your personal information.
- Where a Prize includes a holiday, accommodation and/or flight details will be set out in the Specific Terms and Conditions and/or the promotional materials for the Promotion. Unless specified in the Specific Terms and Conditions, the Prize excludes hotel / cruise and airport transfers. The Winner and any guest(s) must travel on the same itinerary and all parts of the Prize must be used in conjunction with the same booking.
The Winner and any guest(s) are solely responsible for ensuring they have valid travel documentation (including passport/visa/visa waiver as may be required), obtaining adequate travel insurance and appropriate vaccinations/inoculations for foreign travel at their own expense.
- The Winner is responsible for paying all costs and expenses that are not included within the prize, but are incidental to the Winner redeeming the Prize, including (for example), transport, accommodation, meal costs, spending money, insurance and all other incidentals. The Winner is also responsible for any personal expenses and any VAT, national and/or local tax liabilities (if any) incurred in claiming or using the Prize. If the Winner's guest is a minor, the minor must be accompanied by their parent or legal guardian, or a notarised letter must be obtained in line with the supplier terms and conditions authorising the minor to travel.
- The Promoter reserves the right at any time to cancel, modify or supersede the Promotion (including altering Prizes) if, in its discretion, the Promotion is not capable of being conducted as specified.
Winner Notification and Claiming Prize
- The Promoter will use its reasonable endeavours to notify the Winner by email or phone or using the other contact details provided to the Promoter within 7 days of the end of the Promotion Period unless otherwise stated. The Winner needs to confirm acceptance of the Prize within 5 working days of being notified they have won, unless otherwise stated.
- If a Winner cannot be contacted within this 7 day window, the Promoter reserves the right to redraw a new Winner at random, from the remaining valid entries that were received during the Competition Period.
- The Promoter proposes to publish the name of the Winner (subject to any objections). To see the Winner's name and county, please send a stamped self-addressed envelope by no later than 28 days after the end of the Promotion Period to MY KIND LTD, Devonshire House, 582 Honeypot Lane, Stanmore, Middlesex, HA7 1JS specifying which competition or promotion winner details you require.
- In the event of a winner not wishing to make their name available in the public domain, they acknowledge that My Kind Ltd may still be required to share their details with the Advertising Standards Authority or other regulators.
Publicity and Data Protection
- The Promoter will collect and process participants' personal information in accordance with the privacy policy at https://www.mykindofcruise.com/privacypolicy
Liability
- Nothing in these Terms and Conditions shall in any way limit or exclude the Promoter's liability for fraudulent misrepresentation, death or personal injury caused by its negligence, breach of Entrants' statutory rights as consumers, or for any other matter where liability may not be limited as a matter of law.
- The Promoter will not be responsible for any damage, loss or injury resulting from participants' entry into the Promotion, or their acceptance and/or use of the Prize, or for technical, hardware or software failures, lost, faulty or unavailable network connections or difficulties of any kind that may limit or prohibit participant's ability to participate in the Promotion. Your statutory rights are not affected.
- The Promoter will not be responsible for any lost, damaged, defaced, incomplete, illegible or otherwise unreadable entries to the Promotion.
- Without prejudice to a participant's statutory rights and, to the extent permitted by applicable law, the Promoter, its agents or distributors will not be responsible or liable to compensate the Winner or accept any liability for any loss or damage incurred by or any personal injury or death occurring as a result of taking up a Prize.
- The title in the Prize and any risk of loss or damage to the Prize will pass to the Winner upon delivery of the Prize to said Winner.
General
- The Promoter's decision as to the Winner of the Prize is final and binding on participants. The Promoter will not enter into correspondence with participants in relation to this decision.
- Participants agree to keep confidential any information of whatsoever nature regarding the Promoter and its businesses, personnel, agents, sponsors and event promoters received by Entrants as a result of winning or participating in any Promotion.
- Unless otherwise stated in the promotional materials and/or Specific Terms and Conditions, the competition is in no way sponsored, endorsed or administered by, or associated with, the manufacturer of the relevant Prize and/or the Prize Provider. Participants are providing their information to the Promoter and not to the manufacturer of the relevant Prize and/or the Prize Provider (although, if a participant wins, their details may be disclosed to the Prize Provider in order to provide them with the Prize).
- Any participant who enters or attempts to enter the Promotion in a manner, which in the Promoter's reasonable opinion is contrary to these Terms and Conditions or by its nature is unjust to other participants (including tampering with the operation of the Promotion, cheating, hacking, deception or any other unfair playing practices such as intending to annoy, abuse, threaten or harass any other participants or the Promoter and/or any of its agents or representatives) may be rejected from the Promotion at the Promoter's sole discretion.
- These Terms and Conditions are governed by English law. The courts of England and Wales shall have exclusive jurisdiction to hear any dispute or claim arising in connection with the Promotion or these Terms and Conditions.
- The Promoter may transfer all or part of its rights under these Terms and Conditions to someone else without obtaining your consent; provided such transfer does not significantly disadvantage you.
- The Promoter and/or its affiliates may amend or withdraw any element of a Promotion for any reason beyond its reasonable control. The Promoter and/or its affiliates are not responsible for any loss or damage caused to you as a result of any event beyond its reasonable control.
- Any provision of these Terms and Conditions which is deemed illegal and/or prohibited or unenforceable under any applicable law will be ineffective to the extent of such illegality, prohibition or unenforceability without invalidating the remaining terms and provisions of the conditions.
- Winner will be announced by live stream on a social platform of our choosing, we will only disclose your first and last name provided in the entry form.
